When Multiple Ownership Interests Are Involved

If title to a property is held by tenants in common, each owner has an ownership interest in the property. Owners hold their respective share of the property as individuals, can convey or transfer their interest in the property, and can hold unequal shares of the property. A distinguishing characteristic of tenants in common is that there is no right of survivorship. That is, if one tenant passes away, their interest in the property does not automatically go to the other owners, but instead transfers to a person of their choice.

Maryland law presumes that owners hold title to a property as tenants in common unless otherwise specified. Similarly, our lawyers will presume that nonmarried owners wish to hold title to a property as tenants in common.

Ensuring A Timely Closing

Our team will work closely with you to help the closing process go as smoothly as possible. We can gather all the necessary mortgage information on the property, make note of any maintenance contracts, perform a judgment search, and ensure that your signature appears as required by law on any necessary documents, particularly if you are unable to attend the closing in person, and will be carrying out your functions by mail.
